RSH Moves Retreat Agreement, Waiver & Release of Liability
Please read this carefully and in full. By checking the box below, typing your name, and/or sending payment to reserve your space, you agree to be legally bound by this agreement. It is a binding contract between you ("Participant") and Raydene Salinas Hansen, doing business as RSH Moves ("RSH" or "Organizer"), who is the lead instructor and retreat director.

1. Reservation
To reserve a space, you must accept this agreement and submit the total amount due, as listed on the retreat page. This agreement takes effect as soon as you accept it. Payment, cancellation, and refund terms are set out in the Terms & Conditions, which are part of this agreement.
2. Eligibility
You confirm that you are at least 18 years old, are legally able to enter a binding contract under the laws of Massachusetts and your state or country of residence, and are emotionally, medically, and physically able to take part in the retreat.
3. Your Health and Physical Condition
Every form of movement carries some risk of injury. Some yoga postures, strength exercises, and somatic practices are not right for every body. You are responsible for making sure your health permits you to participate, including consulting a health-care professional before you attend. RSH relies on the fact that, by participating, you have done so. If you feel pain or significant discomfort during any activity, you agree to stop, tell the instructor right away, and seek medical attention from a licensed provider if needed. Every class, pose, and exercise is voluntary, at your sole discretion, and at your own risk.
4. Assumption of Risk
You understand that participating involves risks, which can lead to physical, emotional, or property harm, up to and including illness, disability, or death. These risks can come from your own actions or from the actions of others. You also understand that international travel adds its own risks, including travel and ground transportation, unfamiliar environments and food or water, differences in local laws and customs, and medical care that may be different from, or less available than, what you are used to. You accept these risks, including ones you haven't thought of, and choose of your own free will to participate.
5. Waiver and Release of Claims
In exchange for being allowed to participate, you waive, release, and discharge any and all claims, debts, liabilities, costs, expenses, and causes of action, including those arising from ordinary negligence, for injury, illness, death, or loss of or damage to property (yours or your guests') that result from or relate to your participation in the retreat. This applies to RSH and its owners, officers, employees, contractors, volunteers, facilitators, vendors, agents, and representatives, as well as Casa Fuzetta, the retreat venue and its owners and staff, and any third-party providers of transportation, excursions, or services connected to the retreat (together, the "Released Parties"). This waiver does not apply to claims for personal injury caused by the intentional wrongful acts of a Released Party.
6. Indemnification
You agree to defend, indemnify, and hold harmless the Released Parties against any claims and demands, including reasonable attorney's fees, that arise from or relate to your participation in the retreat or your conduct or actions (or those of your guests), including any claims you have waived above. The Organizer may choose its own legal counsel and take part in its own defense.
7. Travel, Insurance & Documents
You are responsible for your own passport, visa, and entry requirements, your travel arrangements, and your personal belongings. We strongly recommend travel insurance that covers trip cancellation and medical care and evacuation. RSH is not responsible for costs caused by travel disruptions, delays, or changes outside its control.
8. Photography Consent
You give RSH permission to use your photo, video, or other digital likeness in its publications, including web and social media, without payment. Photos become RSH's property, and RSH may edit, copy, publish, and distribute them for any lawful purpose. You waive the right to inspect or approve the finished material and to any royalties or compensation. Note: If you would prefer not to be photographed, tell us at registration and we will honor that.
9. Governing Law & Disputes
This agreement is governed by the laws of Massachusetts, without regard to conflict-of-law rules. Any dispute arising under it will be resolved through confidential binding arbitration in Falmouth, Massachusetts, before a single arbitrator under the then-current rules of the American Arbitration Association.
10. General
This agreement binds you and your personal representatives, and should be enforced to the fullest extent the law allows and interpreted as broadly as possible in the applicable jurisdiction. If any part is found invalid, the rest stays in full force. This is a release of specific claims relating to the retreat, not a general release of all claims.
Acknowledgment
I have read this agreement fully, I understand it, and I agree to be bound by it. I understand that by agreeing, I give up the right to hold the Released Parties responsible for injury, loss of property, or loss of life that may occur during or after the retreat, except as stated in Section 5.
